Conditions of Sale

Sales of products from the website shop.manuelcaffe.it are governed by the following General Conditions of Sale. The General Conditions of Sale are drawn up in compliance with legislation on contracts agreed outside of retail premises and in particular in compliance with Italian Legislative Decree 206 of 6/9/2005 (Consumer Code).

Parties to the contract

The parties to the contract are:
- D.M.C. srl with registered headquarters in Via dei Bar 14 – 31020 San Vendemiano Tax Code and VAT number 00713150266.
- Customer: the end user and natural person acting for non business or professional purposes, identified by the shop.manuelcaffe.it website, who places an order accepted by Manuel Caffè.

Application and modification of General Conditions of sale

Placing of an order on the website means the Customer has read all the instructions provided during the purchase procedure and accepts all the General Conditions of Sale. Manuel Caffè reserve the right to vary the General Conditions of Sale, informing users of any variations on this page of the website. The applicable General Conditions of Sale are those if force when an order is placed. Any modification will only come into effect after publication on the website.

Registration on the website

Registration with username and password is obligatory.

Characteristics and prices of products or services

Images of the products may not perfectly represent the product characteristics, which may differ in colour, size and accessories from those shown. All the information provided to help purchases is to be regarded purely as generic information, and does not refer to the actual characteristics of an individual product.
Products are offered at the price given on the website on the date the order is placed.
Prices do not include VAT, which will be added during checkout, before payment confirmation.
Prices do not include delivery charges. These are however given in the final section before confirming the order and specified in the order confirmation email sent to the Customer.

Placing an order

Orders can only be placed for the following destinations: Republic of Italy, Republic of San Marino, the Vatican City and Austria.
Orders have a minimum or maximum quantity limits and availability depends on stock.
Manuel Caffè promotional codes are only valid for the products and period indicated. Promotional codes cannot be refunded and cannot be used in conjunction with other special offers. The promotional code should be entered in the dedicated field when confirming a website order to be valid for the relative discounts and/or offers. Orders cannot be cancelled or renewed in order to enter a forgotten promotional code.
Manuel Caffè promotions are valid while stocks last and subject to the purchase limits given on the website, where specified and in any case for the duration of the promotion on the website pages.
More than one promotion can be applied to an order, unless otherwise specified.
No replacement or refund is possible for any products received free of charge by the Customer.
Stage for placing an order and for confirming the purchase agreement are clearly highlighted in the sequence of pages on the website, with explanatory text and images.
After payment confirmation, the order may no longer be cancelled or modified.

Order confirmation and acceptance

Once an order is received, Manuel Caffè automatically sends out an email confirmation reiterating all the details of the same.
Should Manuel Caffè not be able to process an order, the Customer will receive prompt communication to this effect.
The Customer is not entitled to any compensation or indemnification for damages, or any contract or non-contract liability for direct or indirect damages to persons and/or objects caused by refusal of an order.

Accepted payment methods

Manuel Caffè only accepts the following payment methods:
ITALY, AUSTRIA, FRANCE AND BELGIUM
- Credit card (American Express, Visa or Mastercard); via the designated payment platform.
- PayPal: online payment system that allows any company or Customer with an email address to send and receive payment after registration. Payment is made via the PayPal payment platform.
- Bank Transfer

In the case of payment with bank transfer, the order will be processed after Manuel Caffè has received confirmation of receipt of the monies.

Order delivery

Deliveries of products can only be made to the Republic of Italy, San Marino, the Vatican City, Austria and Germany. Manuel Caffè will only deliver the products purchased to the address given in an order. Orders cannot be delivery to PO boxes.
Manuel Caffè sends the products ordered by the Customer with a courier to the address given by the Customer, generally within 24 working hours from order confirmation.. Delivery generally takes place within 4 working days. The times given for order deliveries are indicative.
Delivery costs are invoiced according to rates given on the website or communicated by Customer Assistance on the date the order was placed.
The recipient of the goods is responsible for paying any taxes and custom duties imposed by legislation in force in the territory of destination of the products.
The courier is responsible for delivery. Manuel Caffè shall look into delayed or non-delivery of products reported to Customer Assistance and, if necessary, help Customers to protect their legal rights.

Liability of Manuel Caffè

Manuel Caffè accepts no liability regarding the use the Customer intends to make of the purchased goods.
In the case of goods that are faulty and/or damaged by the courier, Manuel Caffè will only replace those marked as such on receipt of delivery from the courier.
Manuel Caffè declines all liability after 8 days from delivery of goods for spoilt goods that have not reached their expiry date for which it is not possible to ascertain how they were stored.
Manuel Caffè accepts no responsibility for disservices due to causes of force majeure of any kind or genre, in the event that orders cannot be processed by the deadlines agreed in the contract. By way of an example but not limited to, causes of force majeure are provisions by Public Authorities, strikes both general and of its employees or couriers used by Manuel Caffè, as well as any other circumstance outside the control of the latter, including delays in delivery not directly attributable to Manuel Caffè.

Acceptance of the product by the Customer

Any damage to the packaging and/or product or a difference in the number of parcels or instructions must be immediately contested, with details written on the delivery documents. By singing the courier’s document, the Customer confirms that the product is externally undamaged and complies with the order.
Any problems regarding the conditions, correctness or completeness of the products received must be reported within 10 working days from delivery, by email to customercare@manuel.it or by phone to +39 0438/410500.

Invoice

An invoice will be issued for each order placed by a private Customer complete with tax code and for each order placed by business Customers or companies with a VAT number. The invoice will contain the information provided by the Customer when placing the order. Invoices cannot be modified once they have been issued. When placing an order, the Customer must specify if the delivery address is the same or different from the invoice address. In the case of Austrian Customers with a regular Intrastat VAT number, invoices will be issued without VAT.

Right to withdrawal and rules for returns

In compliance with Italian Legislative Decree 21 of 21/2/2014, implementing European Directive 2011/83/UE on consumer rights, the Customer may return the purchased product and obtain a refund of the purchase price paid.
The right to withdrawal may be exercised within 10 days from receipt of the product as follows:
1. Before the deadline above, the Customer may send an email to customercare@manuel.it, expressing their desire to return the goods. (click here for a template withdrawal form)
2. The Customer will then be contacted by Manuel Caffè to arrange pick up of the goods.
The product must be returned within 14 days from receipt of the withdrawal email.
The refund for the cost of the product does not include courier costs.
Should the value of the product be less than when purchased due to handling other than that needed to ascertain the nature, characteristics and working of the product (for example: damaged products, those not packaged appropriately or incompletely, or those products missing certain parts or with damaged parts, such as components, elements, accessories, packing material, boxes, documentation and/or other objects), Manuel Caffè will refund the Customer with the purchase price minus the value of this reduction. Should the Customer return products after the deadline given above or if the products are opened and/or partially used and not suitable for returning, the right to withdrawal shall not apply and Manuel Caffè will return the goods to the Customer, and any costs incurred shall be paid by the Customer.
Within the above limits, Manuel Caffè shall refund the amount effectively paid by the Customer within 14 days from receipt of the withdrawal email, crediting the monies to a bank account or credit card.

Laws in force and place of jurisdiction

Sales of products and/or services take place in Italy and are subject to the Italian laws in force. The place of jurisdiction for resolving any controversy is that nominated by Italian legislation in force when the order is placed.br />The European Commission provides a platform for resolution of controversies on line, with access for European Customers here: http://ec.europa.eu/consumers/odr/

Deliveries

Delivery charges

Delivery charges are calculated according to the order total. Total Delivery charges:
Up to € 25.00 € 10.00 in Italy
Up to € 25.00 € 15.00 in Austria
Over € 25.00 Free
In certain periods of the year, some products may qualify for free delivery. In this case, the entire order will be shipped free of charge.

Delivery of the goods

Manuel Caffè sends the products ordered by the Customer with a courier to the address given by the Customer, generally within 24 working hours from order confirmation.. Delivery generally takes place within 3-4 working days.
The delivery time by the courier is from Monday to Friday, from 9 am to 5 pm. Orders received on Saturday and Sunday will be processed the following Monday: orders received on holidays and when the company is closed will be processed on the next working day.
In any case, delivery times are only and indication and not binding.
The courier is responsible for delivery. Manuel Caffè shall look into delayed or non-delivery of products reported to Customer Assistance and, if necessary, help Customers to protect their legal rights.
The authorised courier will make one attempt to deliver the goods during the daytime; should there be nobody at home, he will leave a note with details of the attempted delivery and a phone number to call.
For deliveries to San Marino and the Vatican City, the recipient of the goods is responsible for paying any taxes and custom duties imposed by legislation in force in the territory of destination of the products.
